1. Acceptance of Terms
By accessing or using the FinCEN RRE Screening Tool ("the Tool"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Tool.
2. Nature of the Tool
The Tool is an informational screening tool designed to help real estate closing professionals assess whether a transaction may be subject to FinCEN's Residential Real Estate Rule reporting requirements.
Important: By using this tool, you acknowledge that (1) the operators are not attorneys and do not provide legal advice, (2) the tool provides informational screening only, (3) you are solely responsible for your compliance obligations, and (4) you agree to hold the operators harmless from any claims arising from your use of this tool.
3. No Warranty
The Tool is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Tool will be accurate, complete, reliable, current, or error-free. Regulatory requirements may change, and the Tool may not reflect the most current rules or interpretations at all times.
4. Limitation of Liability
To the fullest extent permitted by applicable law, the operators of this Tool shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Tool, including but not limited to any penalties, fines, or enforcement actions imposed by FinCEN or any other regulatory body.
5. Hold Harmless
You agree to indemnify, defend, and hold harmless the operators of this Tool from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Tool or your reliance on any information provided by the Tool.
6. User Responsibility
You are solely responsible for determining your compliance obligations under FinCEN's Residential Real Estate Rule. The screening result provided by this Tool is a preliminary assessment only and should not be treated as a final determination of your reporting requirements.
7. Data Collection
The Tool does not collect personally identifiable information (PII) during the screening process. No transaction data is stored. If you voluntarily provide your email address for updates, it will be stored securely and used only to notify you of product updates. We will not sell or share your email with third parties.
8. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of the Tool after changes constitutes acceptance of the revised terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
